Avoiding Disqualification for Alleged Abuse of the Bounce Back Loan Scheme
“… I shall be eternally grateful to Gulshan for his understanding, ability to grasp the facts quickly and making an extremely stressful and emotional process easier for me to navigate, understand and work towards a solution. Gulshan not only set out a successful road map in order to defeat the allegations being pursued, but also provided a support network which was invaluable to me. This all culminated in not just a successful, but very much a just outcome being achieved…”
The Allegation – Abuse of the Bounce Back Loan Scheme
The Insolvency Service (‘IS’) alleged that I had abused the Bounce Back Loan Scheme in completing the application incorrectly in a deliberate or reckless attempt by me to enable my company to receive the sum of £50,000.00. The allegation was incorrect, unfair and not reflective of the facts. As I had never been subject to any investigation in my entire life, I was unqualified to deal with this matter. It was in these circumstances that I sought help and made enquiries online to find a solicitor who was well versed and experienced in dealing with such issues.
It was then that I found Gulshan. After making additional enquiries and speaking with him, it quickly became apparent that in order to provide myself with the best opportunity to defeat the allegations, I needed to have Gulshan on board. I then instructed Gulshan, a decision that ultimately saved me, my family and my career in the music and entertainment industry.
The Outcome
Working closely with Gulshan, we were able to not only convince the Insolvency Service to move from its starting position, but to abandon its investigation into my conduct altogether. What seemed an impossible task at the outset became a reality. Attributable to Gulshan’s passion, knowledge and willingness to listen, he was able to explain how, why and in what circumstances I applied for the Bounce Back Loan, the thought process behind it and the formula used by me when completing it.
Gulshan was able to demonstrate that my actions were not reckless nor negligent. Rather I discharged my duties as director honestly and faithfully as shown by my previous unblemished management of the company. The Insolvency Service subsequently agreed that disqualification was not justified and abandoned its investigation.
“… I have worked in the music and entertainment industry for the last 20 years. Working with world renowned and international music and performing artists. Being engaged in an industry where ‘reputation’ is everything, if I was disqualified it would have been tantamount to professional suicide such would have been its devastating impact.
Attributable to Gulshan’s efforts, working with me, presenting the facts in not only a logical, but convincing manner is what brought about this positive outcome. I cannot thank Gulshan enough for his professionalism, passion and energy which brought about a result which at the start of this process appeared to be an impossibility. Anyone who finds themselves in a similar position would be foolish not to contact Gulshan…”
